Participant risk acknowledgement and liability waiver — draft

Ohio Cannabis VIP · October 14, 2026

DRAFT FOR LEGAL REVIEW — NOT OPEN FOR SIGNATURE. Complete the legal operator and venue identities, event scope, insurance arrangements, and Ohio attorney review before adopting this document. No text can protect against every lawsuit or every form of liability.

NOTICE: THE FINAL DOCUMENT WILL RELEASE CERTAIN CLAIMS FOR ORDINARY NEGLIGENCE. READ IT CAREFULLY BEFORE SIGNING. DO NOT SIGN WHILE IMPAIRED.

1. Parties and event scope

I am the adult participant signing this agreement. The organizer is [LEGAL OPERATOR NAME], operating as Ohio Cannabis VIP. The released parties are that identified organizer, its employees and volunteers acting within the event scope, and the identified venue owner/operator [VENUE LEGAL NAME]. This release applies only to the described event(s) [EVENT, DATE, ACTIVITIES, VENUE] and participation areas disclosed before signature. It does not bind a nonsigning spouse, child, or other person merely because of my signature.

2. Eligibility, voluntary participation, and lawful conduct

I am at least 21, capable of understanding this agreement, and participating voluntarily. I have read the event rules. I understand there are no guest passes, cannabis products included with admission, alcohol service, or guaranteed outcomes. I will not sell, distribute, barter, gift, or exchange cannabis or other drugs at the event. Membership does not authorize conduct prohibited by law, including unlawful consumption or impaired driving. I may decline any activity or leave at any time.

3. Specific risks and assumption of risk

Even with reasonable precautions, social gatherings and travel to and from them may involve slips, trips, uneven surfaces, stairs, lighting limitations, weather, heat or cold, crowds, interaction with other people, noise, allergic reactions, communicable illness, smoke or vapor exposure where lawfully permitted, impairment caused by another attendee, theft or damage to belongings, delayed emergency response, and accidents during optional activities specifically disclosed for an event. Consequences may include physical injury, emotional distress, property damage, disability, illness, or death. I accept the inherent and disclosed risks of my voluntary participation and will ask about risks I do not understand. Specialized activities require additional specific disclosure and consent; this draft does not silently authorize them.

4. Release of ordinary negligence, only where enforceable

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE THE IDENTIFIED RELEASED PARTIES FROM MY OWN CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM MY VOLUNTARY PARTICIPATION IN THE DESCRIBED EVENT AND CAUSED BY THEIR ORDINARY NEGLIGENCE, INCLUDING ORDINARY NEGLIGENCE IN EVENT ORGANIZATION, PREMISES PREPARATION, INSTRUCTIONS, OR SUPERVISION WITHIN THAT EVENT SCOPE. This section does not release gross negligence, reckless, willful, wanton, intentional, fraudulent, discriminatory, criminal, or other conduct that applicable law does not permit me to release. It does not waive nonwaivable statutory rights or legal remedies. It does not release undisclosed activities outside the identified event scope.

5. Participant responsibility and limited indemnity

I remain responsible for my own unlawful acts, intentional misconduct, and property damage caused by my conduct. To the extent permitted by law, I agree to reimburse the identified released parties for third-party losses actually caused by my unlawful or intentional misconduct, proportionate to my responsibility. This provision does not require me to indemnify a released party for its own negligence, unlawful conduct, or a claim I am entitled to bring under nonwaivable law.

6. Health, transportation, and emergency response

I will make my own health decisions, obtain appropriate advice if needed, avoid unsafe impairment, and arrange transportation that does not involve impaired driving. I authorize reasonable efforts to obtain emergency assistance if necessary, without guaranteeing that assistance will be available or successful. Emergency treatment remains subject to law and the treating professional’s obligations. I am responsible for costs legally chargeable to me; this agreement does not prevent lawful claims for those costs.

7. Privacy, conduct, and reporting

I will follow the code of conduct, including age, weapons, alcohol, recording, and sales restrictions. This waiver grants no photo, video, publicity, or marketing permission. Nothing here bars emergency calls, lawful reports to authorities, evidence preservation, complaints about misconduct, or legally required accommodations. Staff may end participation for safety or substantiated violations, consistent with law.

8. No promised outcome; preserved remedies

Membership offers an opportunity for community connection, not a guaranteed social, financial, medical, or other result. The separate membership refund policy applies, subject to mandatory legal rights. A waiver is not permission to operate unlawfully and does not make the venue or an activity legally compliant.

9. Interpretation and electronic signature

Ohio law governs only to the extent applicable and without overriding mandatory law. If a provision is unenforceable, remaining provisions apply only to the extent lawful and consistent with the agreement’s purpose. No forced arbitration, class-action waiver, automatic loser-pays provision, or restriction on lawful reporting is added by this draft. I must receive an accessible printable copy of the exact finalized text and a record of my signature. Material changes require new consent.

10. Signature acknowledgements for the finalized version

I have had time to read the finalized document, ask questions, and seek independent advice. I understand the ordinary-negligence release and its limits. I agree to the described terms voluntarily. Any electronic signature must record my typed full name, authenticated account, affirmative assent, document version/text/hash, date/time, and the event scope. Organizer acceptance and venue details must be completed before the agreement is relied upon.
